1.          This agreement replaces any previous agreements of any nature with regard to the service.

2.          The recorded message service provided by Simplicity Magic will solely be used for entertainment purposes only.

3.         Passwords stay active for a minimum of seven days but may be changed on a weekly basis without given notice from Simplicity Magic to the consumer.  Therefore consumers are advised to watch the explanation of the video within the seven days.  Simplicity Magic will provide a new password for any consumer upon request giving proof of purchase.

4.         Simplicity Magic has the right to withdraw or change the telephone message service and/or telephone number at any given time without giving prior notice to the service users.  Simplicity Magic will provide consumers with a change of telephone number should the number be changed at any given time.  Simplicity Magic will keep the telephone message service live for one year as a minimum to each consumer.  

5.         The telephone service had been specifically designed for Simplicity Magic and Simplicity Magic owns the original recording tracks.

6.         Simplicity Magic will endeavour to ensure the service is working on a daily basis and cannot guarantee to provide a fault-free service.  Simplicity Magic will not be held responsible for poor signal failures should one call from a mobile phone.

7.         Each consumer who purchases the secret of Peter Knows accepts not to disclose the secret to other magicians.

8.          Re-seller rights of Peter Knows are not granted.

9.          Peter Knows is to be performed by the consumer only.

10.      You will not own or have any part share in the service, just the rights to use the service.

11.      Simplicity Magic own the right to perform this on television or radio and a consumer will need written permission from Simplicity Magic to perform this effect under these circumstances.  However there will be a fee for the exclusive rights to perform the effect Peter Knows on television or radio.

12.       Simplicity Magic has an agreement with an independent telephone company, and as a result of which, Simplicity Magic will pay a monthly fee for this service.  A proportion of the cost of the call will be paid to the service provider for the upkeep of the service and another proportion will go towards the running costs, upgrades and product development available with Simplicity Magic.

13.      All calls made in the UK from a UK BT landline are charged by the second and will last no longer than 30 seconds for each call made. The total cost of any given call from a UK BT landline will not exceed £0.10. Calls made from mobiles and outside the UK may vary.  You must be over the age of 16 to make a call  and/or have the bill payer’s permission to make the call. 

14.       Refunds of any particular call made by the caller are at the discretion of Simplicity Magic and there is no legal obligation to a caller by way of compensation in respect of any complaint made by the caller to Simplicity Magic and made in an amount not exceeding the retail cost of the call.

15.       Refunds for the cost of the secret of Peter Knows are again at the discretion of Simplicity Magic and there is no legal obligation for Simplicity Magic to refund this amount.  The consumer will need to give a valid reason in writing for a refund to be considered.  The consumer will also be required to include a stamped addressed envelope for a reply from Simplicity Magic.

16.       Simplicity Magic is dependent on the consumer to use the telephone service in order to keep up with the monthly payments.

17.      Simplicity Magic may terminate the telephone service with immediate effect in the event that the service provider receives an instruction, complaint or objection from a billing carrier.  This will override point number seven.

18.       This telephone message service currently works on the Orange and Vodafone networks.  Some other networks may have a lock on the phone itself resisting the mobile to dial out to this telephone number.  Consumers of this telephone message service can however have their phone unlocked by their current network provider and ask them to accept calls to this mobile number from their phone.  As a result of which, this effect should work on every phone given that the mobile in question accepts calls to this number. However there is no guarantee provided from Simplicity Magic.   

19.      Revenue from calls from personal numbers will not be shared with any other third party except for the use marketing from Simplicity Magic and the service provider.

20.      This agreement shall be governed by English Law.  The parties shall submit themselves to the exclusive jurisdiction of the courts of England.
